The board of education, as an elected representative body of the school system, wishes to provide a forum for citizens to express interests and concerns related to the school system.  In order that the board may conduct an order meeting while providing an opportunity for input, individuals or groups may be heard by the board in accordance with policy 2310, Public Participation at Board Meetings, or policy 2300, Board Meetings (subsection D.2).  
  • Each month, the first part of at least one regularly scheduled board meeting will be set aside for citizens to address the board through public comment. 
  • A sign-up sheet will be available 30 minutes before the meeting begins for any individual or group to indicate their desire to address the board. 
  • Each speaker will receive 3 minutes to present comments.  The public comment session will not exceed 30 minutes total except by majority vote of the board.
  • The board chair will recognize speakers in the order in which they signed in.  Substitute speakers will not be permitted and speakers may not donate any portion of their time to another speaker.  If a speaker is unable to present all of his or her information within the specified time limit, the speaker may provide the board with additional information in written form.  If an unusually large number of people requests to speak, a majority of the board may decide to reduce the time for each individual or to require the designation of a spokesperson for each group of persons supporting or opposing the same positions.  At any time, the board may establish additional procedures to ensure that public comment sessions proceed in an efficient and order manner. 
  • Board members will not respond to individuals who address the board except to request clarification of points made by the presenter.
  • Except in cases of emergency, information received during presentations will not be acted upon at the time it is received.  It will take unanimous vote of the board members present to take action on a presentation considered to be of an unusual or emergency nature at the time it is presented.
  • Disruptions by any person or persons of a public meeting will be subject to action in accordance with G.S. 143-318.17. 
  • Complaints about the performance of school personnel, implementation of board policy, the quality of the educational program, or school facilities should be submitted initially for a response to the school system official responsible for the program or facility or to the superintendent.  The superintendent or designee shall make available policy 2310, Public Participation at Board Meetings, and other relevant grievance procedures to any individual or group submitting a complaint.
  • The board may choose to offer a second opportunity for public comment at the end of the meeting.  Sign-ups will not be required for the second public comment opportunity.
  • No solicitations will be allowed during public comment.

Brevard High Teams Go to Playoffs
Congratulations to the Brevard High School Blue Devils football team, the Brevard High School Men’s and Women’s Cross Country Teams, and the Brevard High School Women’s Volleyball team on their conference achievements!  The BHS Lady Devils were undefeated Mountain Six Champions and went on to the regional conference playoffs before being eliminated one game away from the state championship.  The BHS track teams went to the state playoffs on November 9 and earned several individual awards.  The Blue Devils defeated Hendersonville 22-21 on Friday night and will host Chase in this week’s second round of the 2-A state playoffs.  Go Big Blue!    
 
NC State Elementary Honors Chorus
Six student musicians were selected for the 2019 North Carolina State Elementary Honors Chorus Clinic.  Evie Crider, Odin Cleveland, Sophia Purcell, and Wylie Dodson from Brevard Elementary, and Haley Fort and Emma Stevens from Pisgah Forest Elementary traveled with music teachers Sarah Moser (BES) and Carolyn Smith (PFE) to the annual convention of the North Carolina Music Educators Association (NCMEA) in Winston-Salem on November 9-10.  There they performed with over 200 chorus members from across the state in the beautiful Stevens Center at the University of North Carolina School of the Arts.  Congratulations to these talented performers and their teachers!  
 
2019 RHS Alumni Hall of Fame
At a special ceremony on October 18, Rosman High School inducted five new candidates into its Alumni Hall of Fame.  Congratulations to the following honorees:

Presidential Award for Excellence in Math & Science
Congratulations to Brevard High School teacher Adria Hardy for being honored as a finalist in the North Carolina Presidential Awards for Excellence in Math and Science.  This is the highest honor awarded to a math or science teacher in the state.  Well done, Ms. Hardy!
 
North Carolina Homeless Liaison of the Year
The NC Department of Public Instruction Division for the Education of Homeless Children and Youth recently named Beth Branagan as the Homeless Liaison of the Year for North Carolina.  Congratulations and thanks go to Ms. Branagan for her many accomplishments and all that she does for our most vulnerable population of children. 
 
BES is a “Lowe’s Heroes” School
Congratulations to Brevard Elementary School for being selected as a “Lowe’s Heroes” school for 2019-2020.  Part of this recognition is getting lots of free materials!  The most recent donation to the school included materials to fence the entire track area.  Principal Carrie Norris requested this project to improve safety for students in special needs and K/1 classes.  With the Greenville Highway so close, it is often an area that teachers avoid.  Brevard Elementary School is excited about making its campus more accessible for ALL students. 
 
RHS Seniors Give Back to the Community
On October 15, sixty Rosman High School students and seven adults donated over 400 work hours to bettering their community during the annual Senior Service Day.  About 10 students did a river cleanup project, collecting enough trash and tires that it took three trucks to haul it all to the dump.  HOSA students performed approximately 400 vision screenings for students at RHS, RMS, RES and TCH.  A group worked at TCH painting tiger paws on the driveway and cleaning flower beds and the walking trail.  At RES, student took 5th grade pictures, helped paint their spirit rock, built flower boxes and helped in classrooms.  Students also sorted, organized and purged donations at the Tiger Town Thrift Store.  Organizer Julie Queen tries to find a new group or organization to help each year.  This year, the group that benefited was Ridge Haven Conference Center.  There students helped set up for a fall festival and cleaned up walking trails.  RHS provided each student with a commemorative t-shirt as well as lunch and snacks.  Many thanks to Queen’s Mini Mart and Whitmire Grading for helping fund the event and Headwaters Outfitters for providing the canoes and river guides.

The superintendent has received a request to name the Transylvania County Schools Bus Garage in honor of Howard Blinn Hyatt who passed away in September 2019.  Mr. Hyatt was a teacher in Transylvania County Schools for 36 years, and was considered by many former students to be their favorite teacher.  Mr. Hyatt also served as a school bus driver for 33 years, (while teaching and after retirement), coached softball and football, and ran the concession stand for many years.  He served his country in both the U.S. Army and Marines.   
 
Board policy 9300, Naming Facilities, describes the criteria for naming school system facilities (see attached).  The superintendent will make a recommendation to the board.    
 
The board may take action on the request to name the Transylvania County Schools Bus Garage the Howard B. Hyatt School Transportation Center.

The Fall 2019 PLS Updates have been received from NCSBA.  They include three optional new policies (we are recommending only two) and revisions to 42 current policies (we are recommending 41).  Many of the policies have only minor changes or technical revisions such as changes to cross-references, legal citations, web links or typographical errors.  Others have more substantive changes.  Please note the following information about specific updates:
 
  • Policy 7360/8225, Crowdfunding on Behalf of the School System:  This is an optional new policy established to assist the board in controlling crowdfunding on behalf of the school system.  The policy authorizes employees to engage in crowdfunding activities within the limits established by the policy.
 
  • Policy 4334/5035/7345, Use of Unmanned Aircraft (Drones):  This optional new policy authorizes the use of drones on school property and at school sponsored events with prior approval of the superintendent or designee when certain conditions are met.
 
  • Updates to address new record retention requirements:  The following policies have been updated to reflect the General Records Schedule for Local Government Agencies, the new records retention and disposition schedule applicable to LEAs:  policy 4700, Student Records; policy 5070/7350, Public Records – Retention, Release, and Disposition; and policy 5071/7351, Electronically Stored Information Retention.  
 
  • Policy 7410, Teacher Contracts: This policy was updated to address a change in the teacher contract law.  The policy was updated (1) to add a definition of “year” for purposes of determining a teacher’s years of employment by the board, in accordance with a change in law, and (2) to specify that three consecutive years of employment are necessary for eligibility for a multi-year contract.  Alternatively, the board may count years of employment cumulatively, but to do so the board must modify the policy.
 
  • Policy 3620, Extracurricular Activities and Student Organizations:  This policy was updated to address NCHSAA rule changes.  The update adds new provisions regarding transgender student participation and eligibility of home school students for participation.  
 
  • Updates to address CBD products:  The following policies have been updated to address CBD-containing substances:  policy 4325, Drugs and Alcohol (prohibits all substances containing CBD or THC); policy 6125, Administering Medicines to Students (prohibits the administration of CBD- and THC-containing substances, with some exceptions); and policy 7240, Drug-Free and Alcohol-Free Workplace (prohibits all substances containing CBD or THC).  
 
  • Policy 4333, Weapons, Bomb Threats, Terrorist Threats, and Clear Threats to Safety:  This policy was updated to add other forms of prohibited behavior.  The policy now prohibits these additional forms of conduct:  planting fake explosive devices on school property; threatening an act of mass violence; making a false report of an impending act of mass violence; and planting a fake weapon of mass destruction on school property.
 
  • Policy 5210, Distribution and Display of Non-School Material:  Includes new content to address political signs placed on school rights-of-way during designated periods. 
 
  • Policy 7241, Drug and Alcohol Testing of Commercial Motor Vehicle Operators:  This update is necessary to comply with Federal Motor Carrier Safety Regulations issued in 2016 that have a compliance deadline of January 6, 2020.  The regulations require employers of drivers whose duties require a commercial driver’s license under federal law to conduct queries of the new federal Commercial Driver’s License Drug and Alcohol Clearinghouse.  While there is no requirement that local boards have a policy in place by that deadline, school districts nevertheless must comply with new federal requirements beginning January 6.

Norris Barger will give an update on the progress of the bond construction projects.  Engineers have completed energy consumption data collection and are designing building systems to meet LEED standards.  Initial soil and hazardous materials sampling took place over the holiday weekend.  Architect and CMAR contracts were submitted to the Board of Commissioners in September for approval.  Hopefully, this will take place soon.  Meanwhile, we continue to do as much as we can to move these projects forward. 
 
Conceptual floor plans should be ready on November 18, after which they will be presented to the School Bond Construction Committee and the Board of Education.  Once the board has given its direction, stakeholders will be given opportunities for input on the plans.  Architects will continue developing schematics for the design development phase, during which they will begin drafting and modeling the proposed campuses.  We are also continuing work on the TCS bond website to provide regular updates to the school community and the public.
 
Dr. McDaris will present a resolution exempting certain professional service contracts for the BHS, RHS, and RMS construction project from the RFQ process.

Dr. McDaris and Mr. Barger will give an update on the 2019-2020 budget, including state budget activity.  An updated local current expense budget and summary of fund 2 budget changes for FY20 is attached.

  • Retirement rate increase - 18.86% to 19.70%
  • Health insurance increase - $6,044 to $6,306
  • Step increase for teachers and AP’s – 2.55% average for the first 10 steps (we pay our lowest paid teachers locally)
  • 0% increase for noncertified

11. Resolution Urging Remittance of Civil Penalities Withheld from NC Public Schools

The North Carolina School Boards Association has been working to formulate a responsible payment option for the unpaid $730 million that the state still owes to NC public schools per a 2008 court judgment regarding civil penalties.  The judge ruled that those funds should have been used exclusively for school technology, but were instead unconstitutionally diverted to other purposes.  The General Assembly plans to reconvene in January 2020.  NCSBA believes this gives the General Assembly time to put a payment plan in place months before they work on the next budget during the short session.  To that end, NCSBA has drafted a resolution for local boards to adopt and send to state legislators. 
 
A motion is in order to approve the attached resolution urging the state to take action to remit civil penalties unconstitutionally withheld from North Carolina’s public schools.

North Carolina statute requires board of education members to receive a minimum of 12 hours of professional development training every two years.  Local board policy states that members who attend a professional development activity will provide a report of the event to other board members.  On October 26, Mrs. Wellborn attended the Public School Forum of NC “Color of Education” Summit in Raleigh.  On November 18-20, Mrs. Domokur and Mr. Griffin attended the NCSBA 50th Annual Conference for Board Member Development in Greensboro.  Members will have an opportunity to give reports from these events.
