Following the June 5 board meeting, the administration and board legal counsel requested additional changes to the SHARP Business Systems contract documents for further clarification. Changes were agreed to by SHARP to address the following issues:
- Local current expense appropriation: The obligation is a straight lease with no option to purchase. Thus, the school board retains the discretionary authority regarding the allocation of funds to continue the lease in future fiscal years. The school board can terminate as to any future term if the board determines that sufficient funds have not been received for local current expense obligations.
- Policy 6425: Per policy, this is a straight lease and no formal bidding is required. However, staff has reviewed the value of the contract compared to existing service in making this final recommendation.
- Agreement renews from month-to-month at the end of the term until a 30-day notice is given.
- Contract changed to provide governed by North Carolina law.
A motion is in order approve the Sharp Master Lease Agreement, Schedule to Master Lease Agreement, Maintenance Agreement and Terms to Maintenance Agreement.
